This policy explains what personal information Nergy Web Design Solution collects through nergywebdesign.com, why we collect it, who we share it with, and the choices you have. We have written it in plain language on purpose.

Nergy Web Design Solution (“Nergy”, “we”, “us”) is a web design and digital growth business based in Enugu, Nigeria. We operate the website nergywebdesign.com and are the data controller for the personal information described in this policy.

We handle personal information in line with the Nigeria Data Protection Act 2023 and the Nigeria Data Protection Act General Application and Implementation Directive 2025, which are overseen by the Nigeria Data Protection Commission (NDPC). Where we serve clients outside Nigeria, we apply the same standards to their information.

Information you give us

You give us information when you fill in a form on this website. Depending on the form, this can include:

  • Your name and your business name
  • Your email address and phone number
  • The service you are interested in, your budget range and how you heard about us
  • What you tell us about your project, your website and your current marketing
  • Your answers to the Business Growth Diagnostic questions and the growth score they produce
  • Registration details when you sign up for training, a course or a waitlist

You also give us information when you email us, call us or message us on WhatsApp.

Account and course information

If you enrol in one of our online courses, we create an account for you. That account holds your name, email address, login details and your progress through the lessons.

Payment information

Payments on this website are processed by Paystack. Your card details are entered on Paystack’s own secure page. We never see or store your card number, CVV or bank login. What we keep is the record of the payment: the amount, the reference, the date, the status, and the name, email and phone you used.

If you pay by bank transfer instead, we receive the details of that transfer from our bank in the normal way.

Information collected automatically

When you visit the website, some information is collected automatically:

  • Your IP address, browser type and device information
  • The pages you visit, how you arrived and how long you stay
  • The date, time and IP address recorded with any form you submit, which helps us prevent spam and abuse
  • Standard server logs kept by our hosting provider

If you use the domain name checker on our Resources page, we send the domain you typed to the relevant domain registry to check whether it is available, and we temporarily count requests from your IP address so that no single visitor can overload the tool.

We use personal information to:

  • Deliver the work, training or course you have paid for
  • Produce your diagnostic result and recommend the services that fit your situation
  • Take payment and keep proper financial records

  • Keep the website secure, working and free of spam
  • Understand which pages and campaigns bring people to us, so we can improve the site
  • Meet our legal and tax obligations

We rely on your consent where you have asked to hear from us or agreed to non-essential cookies, on the need to perform our contract with you where you are a client, on our legitimate business interests in running and improving the website, and on legal obligations where the law requires us to keep records.

We do not sell your personal information, and we do not share it with anyone for their own marketing.

5. Who we share it with

We share personal information only with the service providers that help us run the business, and only as far as each one needs it:

  • Hostinger — hosting for this website and delivery of the emails it sends
  • Paystack — card and bank payments made on this website
  • Google — Google Tag Manager, which loads our website measurement tags, and the Google reviews shown on our pages
  • Systeme.io — the email list used for our Growth Brief updates, if you signed up for them
  • Our accountant, bank or professional advisers, and any authority we are legally required to give information to

Some of these providers store information on servers outside Nigeria. Where that happens, we rely on providers that commit to recognised data protection standards.

Our Resources page recommends hosting companies and other tools through affiliate links. If you buy through one of those links, we may earn a commission at no extra cost to you. Once you click through, you are on that company’s website and their privacy policy applies, not ours. The same is true of our social media pages and any other website we link to.

7. Cookies and similar technology

Cookies are small files a website stores in your browser. This website uses:

  • Essential cookies that make the site work — page caching, form security and staying logged in to a course
  • Measurement cookies set through Google Tag Manager, which tell us how people find and use the site
  • Browser storage that remembers, for the length of your visit, which campaign or link brought you to the site

You can block or delete cookies in your browser settings at any time. If you block essential cookies, parts of the website may stop working properly.

8. How long we keep it

  • Enquiries and diagnostic results: up to 3 years from your last contact with us, so we can pick up where we left off
  • Client project records and payment records: at least 6 years, because tax and accounting rules require it
  • Course accounts: while your account is active, and for 12 months after it is closed
  • Email list subscriptions: until you unsubscribe
  • Website and server logs: for a short period, as part of normal hosting

9. How we protect it

The website runs over a secure HTTPS connection. Access to form submissions, course accounts and payment records is limited to people at Nergy who need it, and is protected by individual logins. No website can promise perfect security, but we take these protections seriously and review them as the site grows.

10. Your rights

Under Nigerian data protection law you have the right to:

  • Ask what personal information we hold about you and get a copy of it
  • Have information corrected if it is wrong or out of date
  • Ask us to delete information we no longer have a reason to keep
  • Ask us to restrict or stop a particular use of your information
  • Object to us using your information for our legitimate interests
  • Receive the information you gave us in a portable format
  • Withdraw your consent at any time, including by clicking unsubscribe in any marketing email

To exercise any of these rights, email info@nergywebdesign.com. We will respond within 30 days. Exercising your rights is free, and we will never treat you differently for doing so.

If you believe we have mishandled your information, please tell us first so we can put it right. You also have the right to complain to the Nigeria Data Protection Commission.

11. Children

This website and our services are meant for businesses and adults. We do not knowingly collect personal information from children. If a child has given us their information, contact us and we will delete it.

12. Changes to this policy

We update this policy when the way we handle information changes. The date at the top of the page always shows the current version. If a change is significant, we will make it clear on the website.
